General terms of use of the CloudFret application

Welcome to CloudFret, a road freight platform that connects carriers, freight forwarders, and shippers.

These Terms of Use "TOS" govern the use of the CloudFret application by users, who agree to comply with them.

1. Adhesion

1.1. To use the Application, the User must create an account and accept these TOS.

1.2. The User must provide accurate and complete information during registration and update this information regularly.

1.3. CloudFret reserves the right to refuse adhesion to the Application at its discretion, notably in case of non-compliance with these TOS.

2. Services

2.1. CloudFret offers a platform that allows carriers to offer their empty trucks for loading and shippers to book the transportation of their goods.

2.2. The rates, the transport conditions, and other specific details are negotiated directly between the carriers and the shippers. CloudFret is not responsible for transactions between Users.

3. Subscription

3.1. CloudFret offers monthly and quarterly subscriptions for Users without commitment.

3.2. The subscription fees are indicated on the Application and are subject to change. Users will be informed of any rate changes before they take effect.

3.3. Subscription payments are made via the payment methods available on the Application.

4. Cancellation of Subscription

4.1. Users can cancel their subscription at any time by following the instructions provided on the Application.

4.2. No refunds will be made for subscription periods already paid.

5. User Responsibilities

5.1. Users agree to use the Application in accordance with applicable law and these TOS.

5.2. Users are responsible for the confidentiality of their account information.

5.3. Users agree not to disrupt the proper functioning of the Application or to use the Application in a fraudulent manner.

6. Insurances

Each user agrees to subscribe, at their own expense, with one or more insurance companies duly approved by the competent authorities and of proven solvency, for amounts sufficient to cover the financial consequences they may incur, notably in case of bodily, material, or immaterial damage, caused to another user or to their clients or to third parties in the context of the execution of transport operations via the application.

These insurances must be in effect from the date of registration on the application and until the termination of the account or the subscription.

7. Right of Image

CloudFret reserves the right to use the visual identity of users for communication/marketing purposes in the various public or private publication channels.

8. Modification of TOS

CloudFret reserves the right to modify these TOS at any time. Users will be informed of the modifications via the Application. Continued use of the Application after the publication of the modifications constitutes acceptance of the new TOS.

9. Applicable Law and Jurisdiction

These TOS are subject to Moroccan law.

The courts of Casablanca will have sole jurisdiction to hear any dispute concerning the validity, interpretation, and execution of these TOS and all that may result or be consequential to it.

10. Collection and Processing of Data

10.1. CloudFret collects and processes the personal data of Users in accordance with its Privacy Policy. The data collected is used to improve the services of the Application, facilitate transactions, and ensure the security of Users.

10.2. Users consent to their data being used for the operational needs of CloudFret, including, but not limited to, improving services, research and development, and marketing communications.

10.3. CloudFret commits to protecting the personal data of Users and not to disclose it to third parties without their prior consent, except if the law requires it or to meet legal obligations.

11. Carrier Responsibility

CloudFret acts as a platform for connecting shippers and carriers, facilitating transactions and interactions between these parties. However, CloudFret cannot be held responsible for the actions, behaviors, or practices of the carriers registered on its platform.

Shippers and carriers are required to comply with all laws and regulations in effect in the jurisdictions where they operate, and it is their responsibility to verify the legality of the goods transported.

CloudFret cannot be held responsible for any damage, loss, or harm resulting from a violation of these obligations by the carriers.
